By accessing, browsing, or purchasing any products or services through Our website, physical store, or other sales channels, You acknowledge that You have read, understood, and agreed to be bound by these Terms, as well as any additional policies referenced herein (including but not limited to Our return and refund policy and jewelry authenticity guarantee policy).
Your use of Our services and/or purchase of any of Our products signifies Your acceptance of these Terms. If You do not agree to these Terms, You may not access or use Our services or purchase Our products. We reserve the right to modify these Terms at any time without prior notice. Modified Terms will be posted on Our website and will take effect immediately upon posting. Your continued use of Our services or purchase of products after the posting of modified Terms constitutes Your acceptance of the modified Terms.
2.1 We strive to provide accurate and up-to-date information about Our jewelry products, including descriptions, images, materials (e.g., precious metals, gemstones), craftsmanship, dimensions, and pricing. All jewelry products are described to the best of Our knowledge, including details about salvage or vintage pieces (if applicable). However, We do not warrant that product descriptions or other content on Our website or other sales channels are accurate, complete, reliable, current, or error-free. Due to the natural variation in gemstones (e.g., color, clarity, cut) and handcrafted nature of many jewelry pieces, slight differences between the product image and the actual item may occur and are not considered defects.
2.2 Product availability is subject to change without notice. We reserve the right to discontinue any product at any time, including salvage or limited-edition jewelry pieces. 2.3 For custom jewelry orders, all design details, materials, and pricing will be confirmed in writing prior to production. Custom orders are non-cancelable once production has begun, and any changes to custom designs may result in additional fees and delays. We will provide a timeline for custom production, but this timeline is an estimate and may be subject to delays due to material availability or craftsmanship requirements.
3.1 When You place an order with Us, You are making an offer to purchase the selected jewelry products subject to these Terms. All orders are subject to Our acceptance. We may refuse or cancel any order for any reason, including but not limited to product unavailability, errors in product information or pricing, suspected fraudulent activity, or concerns about the authenticity of payment or shipping information.
3.2 Upon receipt of Your order, We will send You an email acknowledgment confirming receipt of Your order (the “Order Acknowledgment”). This does not constitute acceptance of Your order. Acceptance of Your order will occur when We send You a shipping confirmation email with tracking information (the “Shipping Confirmation”), at which point a binding contract between You and Us will be formed. For custom orders, acceptance occurs when We send You a written confirmation of the custom design and pricing.
3.3 You are responsible for providing accurate and complete information when placing an order, including Your shipping address, contact phone number, and payment details. We will not be liable for delays, non-delivery, or loss of products due to incorrect or incomplete information provided by You. If You need to update Your order information after placement, please contact Us immediately; We cannot guarantee that changes can be made once order processing has begun.
4.1 All product prices are displayed in US Dollars (USD) and are subject to change without notice. We are not responsible for typographical errors in pricing. In the event of a pricing error, We will notify You promptly and offer the option to cancel the order or proceed with the correct price. For jewelry products containing precious metals or gemstones, prices may fluctuate based on market values; We will confirm the final price at the time of order acceptance.
4.2 Payment must be made in full at the time of order placement for standard products. For custom jewelry orders, a 50% deposit may be required to initiate production, with the remaining balance due prior to shipping. We accept major credit cards, debit cards, and other payment methods as indicated on Our website or at the point of sale. By providing payment information, You warrant that You are authorized to use the payment method and that the payment information is accurate.
4.3 We reserve the right to charge applicable sales taxes based on the shipping address and applicable local, state, and federal laws. For international shipments, additional customs duties, taxes, or fees may apply, which are the sole responsibility of the Customer.
5.1 We take special care in packaging jewelry products to ensure safe delivery. All jewelry shipments are insured against loss or damage during transit. We will ship products to the shipping address provided by You at the time of order placement. Shipping times and costs will vary depending on the shipping method selected and the destination. Estimated shipping times are provided for reference only and are not guaranteed. We will not be liable for delays in shipping due to circumstances beyond Our control, including but not limited to weather conditions, carrier delays, customs issues (for international shipments), or material shortages for custom orders.
5.2 Risk of loss or damage to the products passes to You upon delivery of the products to Your designated shipping address. If You receive a package that is damaged or tampered with, please document the damage with photos and contact the shipping carrier and Our customer service immediately. If a package is lost in transit, We will work with the shipping carrier to resolve the issue and provide a replacement or refund (whichever You prefer) once the loss is confirmed.
5.3 For international shipments, You are responsible for any customs duties, taxes, or other fees imposed by the destination country. We are not responsible for delays or issues related to customs clearance, and We will not falsify customs declarations (e.g., marking items as “gifts” to avoid fees).
6.1 We offer a 14-day return policy for most standard jewelry products purchased from Us. To be eligible for a return, the product must be unused, in its original condition, with all tags, packaging, certificates of authenticity (if applicable), and accessories intact. Custom jewelry orders, personalized products, salvage jewelry (unless sold with a specific warranty), and clearance items marked as “final sale” are not eligible for return or refund, except in cases of manufacturing defects or authenticity issues.
6.2 To initiate a return, please contact Our customer service at +1 3476165345 or support@jolanjewels.shop within 14 days of receiving the product to request a return authorization (RA) number. Returns without an RA number will not be accepted. You are responsible for the cost of returning the product, including insurance for high-value items, unless the return is due to a manufacturing defect, authenticity issue, or an error on Our part (e.g., wrong product shipped).
6.3 We will inspect returned products upon receipt. For standard returns, if the product is eligible, We will process a refund to the original payment method within 5-10 business days of inspecting the returned product. Refunds will exclude any shipping costs paid by You, unless the return is due to Our error. For returns due to manufacturing defects or authenticity issues, We will provide a full refund, including the cost of returning the product, or a replacement product (if available).
6.4 All jewelry products are guaranteed to be authentic as described. If You believe a product is not authentic, please contact Us immediately and provide a written appraisal from a certified gemologist or jewelry appraiser. We will investigate the claim and, if the product is found to be inauthentic, provide a full refund plus the cost of the appraisal (up to $200) or a replacement product.
7.1 All intellectual property rights in and to Our jewelry designs, products, website, logos, trademarks, product images, certificates of authenticity, and other content (collectively, “Intellectual Property”) are owned by or licensed to Us. This includes all designs for custom jewelry created by Our team. You may not use, reproduce, distribute, modify, or copy any of Our Intellectual Property without Our prior written permission.
7.2 You acknowledge that any unauthorized use of Our Intellectual Property may violate copyright, trademark, and other applicable laws and may result in legal liability. This includes unauthorized reproduction of custom jewelry designs.
8.1 To the maximum extent permitted by applicable law, We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of value, loss of use, or loss of business opportunities, arising out of or in connection with Your use of Our services or purchase of Our jewelry products.
8.2 Our total liability to You for any claim arising out of or in connection with these Terms or Your purchase of products shall not exceed the total amount paid by You for the products giving rise to the claim. This limitation does not apply to claims for authenticity issues or manufacturing defects, where Our liability shall include full refund and applicable appraisal costs as outlined in Section 6.4.
8.3 Nothing in these Terms shall limit or exclude Our liability for (a) death or personal injury caused by Our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be limited or excluded by applicable law.
You agree to indemnify, defend, and hold harmless Us, Our officers, directors, employees, agents, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with (a) Your use of Our services or purchase of Our products; (b) Your violation of these Terms; (c) Your violation of any applicable laws or regulations; (d) Your infringement of any third-party intellectual property rights, including unauthorized use of Our custom jewelry designs.
We respect Your privacy and are committed to protecting Your personal information, including payment details and contact information. Our Privacy Policy explains how We collect, use, and disclose Your personal information. By using Our services or purchasing Our products, You consent to the collection and use of Your personal information in accordance with Our Privacy Policy.
11.1 Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall first be resolved through good-faith negotiation between You and Us.
11.2 If the dispute cannot be resolved through negotiation within 30 days of the date on which one party notifies the other of the dispute, the dispute shall be resolved by arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Biloxi, Mississippi, USA, and the language of the arbitration shall be English. The decision of the arbitrator shall be final and binding on both parties.
11.3 Nothing in this section shall prevent either party from seeking injunctive relief in a court of competent jurisdiction to protect its intellectual property rights, to prevent the sale of inauthentic products, or to prevent irreparable harm.
These Terms shall be governed by and construed in accordance with the laws of the State of Mississippi, USA, without regard to its conflict of laws principles.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that achieves the closest possible effect to the original provision.
We shall not be liable for any failure or delay in performing Our obligations under these Terms due to circumstances beyond Our reasonable control, including but not limited to acts of God, war, terrorism, riots, strikes, lockouts, labor disputes, natural disasters, fire, flood, hurricane, pandemic, or government actions. We will notify You promptly of any such event and take reasonable steps to mitigate the impact of the event.
